Terms & Conditions – Release of Liability
1. Upon purchase of any “Seller” Simplex Terra, Inc. product, or any related product, “Simplex Terra, Inc.” product. The seller “Simplex Terra, Inc.” hereby releases all liability and risk involved in consumption of any “Simplex Terra, Inc.” products, or any partner products. The buyer shall take full responsibility and risk involved in consumption of any “Simplex Terra, Inc.” products.
2. THE LIABILITY. Under the terms of this Release and sufficiency of which is hereby acknowledged, the “Buyer” hereby releases and forever discharges the "Seller" SimplexTerra Inc. of: Any and all liabilities or damages involved with consumption of a “Simplex Terra, Inc.” product, described in detail herein. (4)
3. PAYMENT. As part of these conditions, the buyer agrees to make payment directly to “Simplex Terra, Inc.” of price stated for the product purchased. All Sales are final.
4. RELEASE. THEREFORE under the terms of these “Terms & Conditions” and sufficiency of which is hereby acknowledged, by purchasing this product do hereby release and forever discharge “Simplex Terra, Inc.” including their agents, employees, successors and assigns, and their respective heirs, personal representatives, affiliates, successors and assigns, and any and all persons, firms or corporations liable or who might be claimed to be liable, whether or not herein named, none of whom admit any liability to the buyer, but all expressly denying liability, from any and all claims, demands, damages, actions, causes of action or suits of any kind or nature whatsoever, which now have or may hereafter have, arising out of or in any way relating to any and all injuries and damages of any and every kind, including all medical emergencies, including death, to both person and property, any and all injuries and damages that may develop in the future, as a result of or in any way relating to the liability, or be held responsible for any monetary liability from any and all situations or suits. If the buyer distributes any Simplex Terra product after purchase, buyer claims all liability expressed herein. “Simplex Terra, Inc.” shall be reimbursed for any financial loss due to any legal action or disruption to normal business operations. It is understood and agreed that these terms are made and received in full and complete settlement and satisfaction the causes of action, claims and demands mentioned herein; that these terms contain the entire agreement between the Seller, “Simplex Terra Inc”; and the buyer that the terms of this Release are contractual and not merely a recital. This product is suggested for persons 18 years or older, please consult your physician before using any “Simplex Terra, Inc.” product. This Release shall be binding upon purchase, and their respective heirs, executors, administrators, personal representatives, successors and assigns.
